Article 1. Purpose

By applying for the Influencer Program (the “Program”) managed by CJ Olive Young Co., Ltd. (the “Company”), Members (“Members”) are deemed to have read, understood, and agreed to these Terms of Use.

Article 2. Eligibility

1. (1) Regardless of the Program type, all Influencers can apply to any Program. However, to be eligible to become an Influencer Member, a member must have a YouTube, Facebook, Instagram, TikTok, Twitter, or Weibo account.
2. (2) The Company determines a member’s eligibility by reviewing the category, content nature, and level of participation using the social media account registered by a member, and members are not allowed to object to the results of the Company’s reviews.
3. (3) A member may not use a social media channel linked to an Olive Young Global Mall account to link it to another Olive Young Global Mall account. Each social media channel may be linked to only a single Olive Young Global Mall account.
4. (4) In the event that a member’s application for an Influencer Membership is rejected, the member may reapply after 30 days from the previous application date.
5. (5) The Company may reject an Influencer Membership application on the following conditions:
   1. 1. There exists an unavoidable reason to reject the application; or
   2. 2. The application violates these Terms of Use.

Article 3. Representation and Amendment of These Terms and Use

1. (1) By participating in the Program and using the Reward Code, a member is deemed to have agreed to these Terms of Use, and these Terms of Use take effect accordingly.
2. (2) The Company may amend these Terms of Use to the extent that such amendment does not violate the Act on the Consumer Protection in Electronic Commerce, Act on the Regulation of Terms and Conditions, Framework Act on Electronic Documents and Transactions, Digital Signature Act, or any other relevant laws. Laws on consumer protection include the Act on Promotion of Information and Communications Network Utilization and Information Protection (“Information and Communications Network Act”) and Act on Door-to-Door Sales.
3. (3) In cases where the Company amends these Terms of Use, the Company shall publish the effective date of and the reason for the amendment along with the current Terms of Use on the Olive Young Global Mall website and notify the information to Members using the email addresses that they have registered from seven days before the effective date until immediately before the effective date. However, in the case of an amendment unfavorable to Members, such information shall be notified or published at least 30 days before the effective date. In this case, the Company shall represent the amended terms in a way that Members can easily understand the changes.
4. (4) In cases where a Member fails to expressly refuse an amendment to these Terms of Use within the period specified in the preceding paragraph, even though the Company published or notified the amendment, the Member shall be deemed to have no intention to refuse the amendment and agree to the amended Terms of Use.
5. (5) In cases where the Company notifies or publishes the amended Terms of Use using the email addresses that Members registered, the Company shall be deemed to have properly notified the amendment.
6. (6) In the event that a Member does not agree to an amendment to the Terms of Use, the Member may request the Company to terminate their Membership.

Article 4. Membership

1. (1) In cases where a member’s application for the Program is accepted, the member’s Membership status shall be changed to Olive Young Global Mall Influencer Membership. After a member’s application is accepted, the member may not change or delete the linked social media account. If you wish to change or delete the linked account, please contact the Customer Service team of Olive Young Global Mall.
2. (2) Olive Young Global Mall may conduct a reliability survey against an Influencer account once a month. In cases where it is found that the member’s account is false, the member’s Influencer Membership may be restricted or suspended without prior notice.
3. (3) In cases where a member becomes an Influencer Member, the member shall receive Olive Young Global Mall points as a sign-up benefit. The points shall be provided upon the acceptance as an Influencer Member, and any unused points shall expire 14 days from the date.
4. (4) In cases where a member signs up for the Influencer Membership, the Company collects the following information:
   1. 1. The social media ID provided by the Influencer Member;
   2. 2. The Influencer Member’s country;
   3. 3. The Influencer Member’s address; and
   4. 4. The Influencer Member’s PayPal ID.

Article 5. Reward Code

1. (1) An Influencer Member may create a unique reward code (“Reward Code”) when applying for the Program.
2. (2) A Reward Code shall be 7–12 characters long and should include uppercase letters and Arabic numerals.
3. (3) Only the Members who have signed up for Olive Young Global Mall, including new members, may use the reward codes. Nonmembers may not use the reward codes.
4. (4) The created Reward Code is automatically included in a product link (“Reward Link”) when an Influencer Member shares the link. The Influencer Member may modify and delete the automatically included Reward Code.
5. (5) Any sale or purchase made through a Reward Link is counted based on the cookies recorded when the link is clicked. The cookies are retained for 30 days.
6. (6) Any purchase made through a Reward Link is updated by the cookies of the last clicked link. As browsers and applications may record cookies separately, they may respectively record the Reward Codes of different Influencer Members.
   In this case, the last Reward Code clicked on the relevant device shall be counted.
7. (7) A Reward Link may be created on the following pages of the Olive Young Global Mall website:
   1. 1. Partnership tab on My Page of the Olive Young Global Mall website;
   2. 2. Product for Sale page of the Olive Young Global Mall website; or
   3. 3. Partnership Event page of the Olive Young Global Mall website.
8. (8) In cases where a member has a friend referral reward code from the Olive Young Global Mall Friend Referral Program (“Friend Referral Code”), the code shall be invalidated when the Reward Code for the new Influencer Membership is provided. However, any order previously made using the existing Friend Referral Code will not be affected.
9. (9) A member may not promote the Reward Code in any manner that may be interpreted as impersonating, representing, or charging against any third party for Commission generation.
10. (10) The Company reserves the right to deactivate the Reward Code at its discretion if the Reward Code is inappropriate or rejectable.

Article 6. Commission and Cash Conversion

1. (1) In cases where an Influencer Member’s followers (“Customers”) purchase products using Reward Codes or Reward Links, a 5% discount will be applied to the Customers.
2. (2) To encourage the use of a Reward Code, an Influencer Member shall receive 5%–13% of the sales amount as separate Commission points, depending on their Influencer revenues. The Commission point rate shall be determined based on the criteria separately notified to Influencer Members. The sales revenues generated from the Reward Codes shall reset on the first day of every month
3. (3) The Commission points generated by a purchase made by a Customer through a Reward Code and a Reward Link will be provided within three days after the delivery date. The points will be returned if the purchase is canceled and refunded after the three-day period.
   In the case of a partial refund, the points will be partially returned, depending on the percentage of the refund amount.
4. (4) The Commission points earned through a Reward Code can be converted into cash, as long as the value of the points is USD 20 or higher. An Influencer Member shall provide the account information required to convert the points into cash, and the Company shall not be responsible for any problems caused by inaccurate account information.
5. (5) Commission points shall not expire until the Influencer Member terminates their account. The points shall be invalidated when an Influencer Member requests to cancel or revoke their participation in the Program.
6. (6) Terms of cash conversion of Olive Young Commission Points

7. (7) The discount rate for Customers and the Commission rate may be modified according to the changes in the Company’s policies. In this case, the Company shall notify or publish the changes under the provisions of these Terms of Use.
8. (8) In cases where the Company becomes incapable of providing services for any reason, including a change of business items, the revocation of the Program, and a merger, the Company shall notify members of such information and compensate Influencer Members and other Consumers according to the specified terms. However, unless the Company notifies the terms of compensation, the points shall be paid to the member in kind or cash, corresponding to the value of the currency accepted in the shopping mall.

Article 7. Restrictions on PR Activities

1. (1) Each Influencer Member is allowed only one Olive Young Global Mall Influencer account.
2. (2) An Influencer Member may use a Reward Code on a personal blog or a personal social media account, including Instagram, YouTube, Facebook, Twitter, TikTok, and Weibo, following the terms applicable to the account. However, an Influencer Member may not include in his/her social media profile any avatar or other content that may be construed as being managed by or related to Olive Young Global Mall.
3. (3) The social media account username and Reward Code must not contain the word “Olive Young” or “Olive Young Global Mall.” Furthermore, the Reward Code must not include any existing or previous Olive Young Global Mall promotion code or coupon code.
4. (4) An Influencer Member shall use only a single social media account per social media platform to promote their Reward Code. Furthermore, an Influencer Member must not use multiple accounts to promote a single Reward Code on the same social media service.
5. (5) The social media account username shall not contain “Olive Young” or “Olive Young Global Mall” or any similar word. Furthermore, a member must not customize his/her Reward Code to make it appear the same as their social media account username. Likewise, a member should not change the social media account username to make it appear the same as their Reward Code.
6. (6) A member may send a Reward Code via email using their email address or the share icon on the Olive Young Global Mall website. However, a member must not write an email that gives the impression that it is sent or sponsored by Olive Young Global Mall.
7. (7) In cases where the Company detects any fraudulent promotions or any other act, including but not limited to the examples listed in these Terms of Use, the Company may immediately delete the registered Influencer Member’s account or suspend the Reward Code.

Article 8. Influencer Partnership

The Company collaborates with Influencer Members who show outstanding performance concerning prizes, product reviews, or coupons sponsored by Olive Young Global Mall. The Company continuously monitors the activities of Influencer Members and may collaborate with Influencer Members who show excellent performance in carrying out events, including special exhibitions.

Article 9. Collection and Use of Information

1. (1) The Company may collect and use content related to Olive Young Global Mall, including content produced by Influencer Members for social media channels or directly submitted by Influencer Members to Olive Young Global Mall for marketing, promotion, and analysis. However, in this case, the Company shall make the best efforts to protect Influencer Members’ personal information, and Influencer Members shall exercise sufficient care before disclosing their information through social media. Such content may include texts, images, videos, and posts that mention Olive Young Global Mall as a sponsor or partner, as well as posts on YouTube, TikTok, Instagram, or other social media based on products received from Olive Young Global Mall or mentioning Olive Young Global Mall in a hashtag. The Company may edit the posts for all products received from Olive Young Global Mall.
2. (2) An Influencer Member agrees to allow the Company to collect his/her content from the Influencer Member’s social media channels and the Olive Young Global Mall website for marketing, promotion, or analysis. An Influencer Member also agrees to grant to the Company’s business partners a nonexclusive and irrevocable right to publish his/her content for marketing, promotion, or analysis. The Company does not guarantee that the Company or its business partners will publish specific content immediately upon being granted such a right. The Company or its business partners may use or publish such content at its or their discretion.
3. (3) In cases where an Influencer Member does not agree to the collection and use of his/her content, the Influencer Member may notify his/her intent to the Company and withdraw from the Program at any time.

Article 10. Suspension and Prohibition of Membership

1. (1) In cases where any content created by an Influencer Member contains Olive Young Global Mall products or the Olive Young Global Mall brand name and includes the following, the Influencer Membership may be terminated.
   1. 1. Abusive language or obscene content
   2. 2. Racist or discriminatory content
   3. 3. Sexual content, including explicit images and videos
   4. 4. Comments responding to or copying the content created by other Influencer Members or content creators
   5. 5. “Spam” content
   6. 6. Discussion on topics irrelevant with its purpose
2. (2) In cases where an Influencer Member’s comment or personal message on a social media channel damages the Company’s brand image, the Company may suspend the Influencer Member’s Membership.
3. (3) In cases where any misconduct, abuse, or other wrongful conduct is detected or suspended, including but not limited to the examples listed above, the Company may immediately prohibit the use of Commissions and Reward Codes and terminate the Olive Young Global Mall Influencer Membership.

Article 11. Withdrawal and Loss of Membership, Etc.

1. (1) A Member may request the Company to terminate his/her Influencer Membership directly via the service, in writing, by phone, or via email. The Company shall change the Member’s account to a regular account immediately upon receiving the request and completing the required procedure.
2. (2) Any previously accumulated Commission points will be deleted upon an Influencer Member’s withdrawal from the Influencer Membership.

Article 12. Indemnification

1. (1) By reading these Terms of Use and clicking the “I agree” button when applying for an Influencer Membership using the form prescribed by the Company, a Member is deemed to agree to these Terms of Use.
2. (2) The Company is not liable for any damage caused by reasons attributable to a Member.
3. (3) The Company does not warrant and is not liable for the completeness, stability, legality, and noninfringement of others’ rights by all and any information, data, and facts posted by a Member or third party (including vendors) unless the Company objectively recognizes and confirms the falsehood and illegality of such information or data.
4. (4) The Company is not liable for any damage caused by the inability to provide services because of a natural disaster or a force majeure event equivalent thereto.
5. (5) In cases where the Company provides its services under any contract executed with a partner site, the Company is not responsible for any damage caused by the services provided by the partner site.
6. (6) The Company may terminate, suspend, modify, or cancel this Program following changes in the Company’s policies. All changes shall be notified or published in accordance with these Terms of Use and shall take effect immediately on the effective date specified in the notification or publication.
